General Terms and Conditions (GTC) – homelex.de

1. Scope
These General Terms and Conditions (GTC) apply to all orders placed via the online shop homelex.de , operated by:

We do not accept any deviating terms and conditions of the customer unless we have expressly agreed to them in writing.

2. Contracting parties, conclusion of contract
The purchase contract is concluded with Ahmet Can Kestane .
The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order. By submitting the order, the customer submits a binding offer to purchase. We will confirm receipt of the order immediately by email. The contract is concluded when we accept the order by sending an order confirmation by email or when we deliver the goods.

3. Prices and payment terms
All prices are in euros (€) including VAT.
Shipping costs are shown separately.

Payment can be made by:

  • PayPal

  • Instant bank transfer

  • Bank transfer

The purchase price is due immediately upon conclusion of the contract.

4. Delivery
We only deliver within Austria and Germany .
The delivery time is 3-10 working days , unless otherwise stated in the offer.
Delivery delays due to third-party suppliers or dropshipping partners entitle us to extend the delivery period.

5. Retention of title
The goods remain our property until full payment has been made.

6. Right of withdrawal / returns
You have the right to withdraw from this contract within 14 days without giving any reason.

7. Warranty / Liability for Defects
The statutory warranty rights apply.
If there is a defect, you can initially request repair or replacement. If this fails, you can request a reduction in the purchase price or withdraw from the contract.
We assume no liability for damage caused by improper handling.

8. Liability
We are only liable without limitation for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty.
We are only liable for other damages in cases of gross negligence or intent.

9. Data protection
Your data will be processed in accordance with our privacy policy. By placing an order, you consent to the collection, processing, and use of your data for processing and shipping purposes.

10. Applicable law, place of jurisdiction
The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for customers residing in Austria is Vienna. For customers residing in Germany, the place of our company headquarters shall be decisive, to the extent permitted by law.

11. Final provisions
Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
